TERMS OF SERVICE

OVERVIEW

This website is operated by Wjoud. Throughout the website, the terms “Wjoud,” “we,” “us” and “our” refer to Wjoud and, where applicable, its registered operating entity.

Wjoud provides this website, including all information, content, features, products, tools and services available through it, to you, the user, subject to your acceptance of these Terms of Service and all other policies and notices published on the website.

By visiting our website, creating an account, placing an order or purchasing a product from us, you engage with our services and agree to be bound by these Terms of Service, together with any additional policies referenced in them or made available through the website, including our Privacy Policy, Shipping Policy and Return and Exchange Policy.

These Terms apply to all visitors and users of the website, including browsers, customers, merchants, suppliers and contributors of content.

Please read these Terms carefully before accessing or using our website. By accessing any part of the website, you confirm that you have read, understood and agreed to these Terms. Should you disagree with any part of them, you must not access the website, place an order or use our services.

Any new products, services, features or tools introduced through the website will also be subject to these Terms. We may update, amend or replace any part of these Terms by publishing a revised version on this page. It is your responsibility to review this page periodically. Your continued use of the website after changes are published constitutes your acceptance of the revised Terms.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which we offer and sell our products.

COPYRIGHT AND INTELLECTUAL PROPERTY

Unless otherwise stated, all content appearing on this website is owned by or licensed to Wjoud. This includes, without limitation, photographs, campaign imagery, videos, illustrations, graphics, logos, designs, product names, written content, styling concepts and website layouts.

You may not copy, reproduce, download, publish, distribute, modify, display, sell or commercially use any content from this website without prior written permission from Wjoud.

Unauthorised use of our intellectual property may result in legal action.

Permission and intellectual-property enquiries may be sent to team@wearejoud.com.

SECTION 1 – ONLINE STORE ELIGIBILITY

By agreeing to these Terms, you confirm that you are at least the legal age of majority in your country or place of residence. Alternatively, you confirm that you are the age of majority and have authorised any minor under your care to use this website.

You may not use our products, website or services for any unlawful, fraudulent or unauthorised purpose. You must not violate any applicable law while using the website, including intellectual-property, privacy, consumer-protection and technology-related laws.

You must not upload, transmit or distribute viruses, malicious code, worms or any material intended to interfere with the website or its users.

A breach of these Terms may result in the suspension or immediate termination of your access to our services.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse or cancel service to any person where reasonably necessary, including in cases of suspected fraud, misuse, unlawful activity, payment disputes, abusive conduct or violation of these Terms.

You understand that information you submit, other than payment-card information, may be transmitted across different networks and adapted to meet the technical requirements of connecting systems or devices.

Payment-card information is encrypted during transmission and is processed by authorised third-party payment providers. We do not directly store complete payment-card information unless expressly stated otherwise.

You may not reproduce, duplicate, copy, sell, resell or exploit any part of the website, our services or access to our services without our prior written permission.

The headings used in these Terms are for convenience only and do not limit or affect their interpretation.

SECTION 3 – WEBSITE INFORMATION

We make reasonable efforts to ensure that the information displayed on our website is accurate and current. However, we do not guarantee that all content will always be complete, error-free or up to date.

Information provided through the website is for general reference and should not be treated as the sole basis for making decisions where more accurate or complete information is reasonably required.

The website may contain archived, editorial or historical content that is no longer current. We may modify or remove website content at any time, subject to applicable law.

SECTION 4 – PRICES AND SERVICE CHANGES

All prices are displayed in the currency shown at checkout and may be subject to applicable taxes, delivery charges, customs duties or other fees.

Prices, promotions and product availability may change without notice. However, changes will not affect an order that has already been accepted by us, except where a genuine pricing or technical error has occurred.

We may modify, suspend or discontinue any part of the website or our services. We will not be liable for such changes except where liability cannot legally be excluded.

SECTION 5 – PRODUCTS AND AVAILABILITY

Certain products may be offered exclusively through our website and may be available only in limited quantities.

All purchases are subject to product availability and our Return and Exchange Policy.

We make every reasonable effort to represent product colours, fabrics, textures, measurements and details accurately. However, colours and visual details may appear differently depending on your screen, device settings, lighting conditions and photography.

As many of our garments may include handcrafted details, natural fabric characteristics or individual finishing, slight variations may occur between pieces. These variations are not necessarily considered defects.

Product measurements are approximate and minor differences may occur. Customers are responsible for reviewing the relevant product description and size information before completing an order.

We may limit product quantities, restrict sales to particular locations or discontinue products where reasonably necessary.

We do not guarantee that every product will meet an individual customer’s personal expectations, provided that the product supplied materially matches its description and is not defective.

SECTION 6 – ORDERS AND PAYMENT INFORMATION

Placing an order does not automatically mean that the order has been accepted. An order is accepted once we send an order confirmation or dispatch confirmation, depending on our order-processing procedure.

We reserve the right to refuse, limit or cancel an order where reasonably necessary. This may include orders that:

  • contain incorrect pricing or product information;
  • are affected by stock or technical errors;
  • appear fraudulent or unauthorised;
  • exceed permitted purchase quantities;
  • appear to be intended for unauthorised resale; or
  • cannot be fulfilled due to circumstances beyond our reasonable control.

Should we cancel an order after payment has been received, the relevant amount will be refunded through the original payment method, subject to the processing time of the payment provider.

You agree to provide complete, accurate and current billing, shipping and contact information. You are responsible for reviewing your details before completing checkout.

We are not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by the customer.

For information regarding returns, exchanges and refunds, please review our Return and Exchange Policy.

SECTION 7 – SHIPPING AND DELIVERY

Delivery estimates are provided in good faith but are not guaranteed unless expressly stated otherwise.

Delivery times may be affected by courier operations, customs processing, public holidays, weather conditions, incorrect customer details, high-volume periods or other circumstances beyond our reasonable control.

Ownership and risk in an order will transfer in accordance with applicable law and the delivery terms communicated at checkout.

Customers ordering outside the United Arab Emirates may be responsible for customs duties, import taxes, clearance charges or other fees imposed by the destination country. Unless otherwise stated, these amounts are not included in the product or shipping price.

Please review our Shipping Policy for further information.

SECTION 8 – OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to services, payment systems, applications or tools operated by third parties.

We do not control these third-party services and provide access to them on an “as available” basis. Your use of any third-party tool is at your own discretion and may be governed by separate terms and privacy policies.

We are not responsible for the operation, security, availability or content of third-party tools except where liability cannot legally be excluded.

Any future services, features or resources added to the website will also be subject to these Terms.

SECTION 9 – THIRD-PARTY LINKS

Our website may contain links to websites or services operated by third parties.

These links are provided for convenience and do not necessarily indicate that we endorse or control the relevant third party.

We are not responsible for reviewing or guaranteeing the accuracy, security, availability, products, services or practices of third-party websites.

Before engaging with a third party or completing a transaction through an external website, you should review its applicable terms and policies. Complaints regarding third-party services should be directed to the relevant provider.

SECTION 10 – REVIEWS, COMMENTS AND SUBMISSIONS

When you submit a review, photograph, message, suggestion, idea, competition entry or other material to us, you confirm that you have the right to share it.

Where you submit content for publication or promotional use, you grant Wjoud a non-exclusive, worldwide and royalty-free right to reproduce, edit, translate, publish and display that content for purposes connected with our business, website, products and marketing, subject to applicable privacy and intellectual-property laws.

We are not required to keep unsolicited submissions confidential, provide compensation for them or respond to them unless we have agreed otherwise in writing.

We may monitor, edit or remove content that we reasonably consider unlawful, misleading, offensive, defamatory, abusive, obscene, infringing or otherwise inappropriate.

Your submissions must not:

  • violate another person’s intellectual-property, privacy or personal rights;
  • contain unlawful, defamatory, abusive or discriminatory material;
  • include viruses, malware or harmful code;
  • contain false or misleading information; or
  • impersonate another individual or organisation.

You remain responsible for the content and accuracy of your submissions.

SECTION 11 – PERSONAL INFORMATION

The collection, use and handling of personal information submitted through our website are governed by our Privacy Policy.

By using the website, you acknowledge that your information may also be processed by service providers necessary to operate the store, including Shopify, payment providers, delivery partners and technology providers, in accordance with applicable law and their respective policies.

SECTION 12 – ERRORS AND OMISSIONS

The website may occasionally contain typographical mistakes, technical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or estimated delivery times.

We may correct such errors, update information or cancel affected orders, including after an order has been submitted, where permitted by law.

Where an accepted order is cancelled because of an error, any payment collected for that order will be refunded through the original payment method.

SECTION 13 – PROHIBITED ACTIVITIES

You must not use the website or its content:

  1. for any unlawful or fraudulent purpose;
  2. to encourage or participate in unlawful conduct;
  3. to violate applicable local, federal or international laws;
  4. to infringe our intellectual-property rights or those of another party;
  5. to harass, abuse, threaten, defame, intimidate or discriminate against another person;
  6. to submit false, deceptive or misleading information;
  7. to upload viruses, malware or harmful code;
  8. to collect or track another person’s personal information without lawful authority;
  9. to spam, phish, scrape, crawl, spider or improperly access the website;
  10. to interfere with the website’s functionality or security;
  11. to bypass access controls or protective measures;
  12. to place fraudulent orders or initiate dishonest payment disputes; or
  13. to use our content, imagery or designs for unauthorised commercial purposes.

We may restrict or terminate access to the website for prohibited conduct.

SECTION 14 – DISCLAIMER OF WARRANTIES

We aim to provide a reliable and secure online shopping experience. However, we do not guarantee that access to the website will always be uninterrupted, timely, secure or error-free.

The website may occasionally be unavailable due to maintenance, technical faults, hosting issues or events beyond our reasonable control.

To the extent permitted by applicable law, the website and its services are provided on an “as available” basis.

Nothing in these Terms excludes warranties, guarantees, remedies or consumer rights that cannot legally be excluded or limited.

SECTION 15 – LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Wjoud and its directors, employees, affiliates, contractors, service providers and licensors will not be liable for indirect, incidental, special or consequential losses resulting from your use of the website or purchase of our products.

This may include loss of profits, revenue, business opportunities, savings or data.

Our total liability relating to a particular order will not exceed the amount paid for that order, except where a greater liability is required under applicable law.

Nothing in these Terms limits liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

SECTION 16 – INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Wjoud, its affiliates, officers, employees, contractors and service providers from third-party claims, losses or reasonable legal expenses resulting from:

  • your material breach of these Terms;
  • your unlawful use of the website;
  • content submitted by you that infringes another party’s rights; or
  • your violation of applicable law.

SECTION 17 – SEVERABILITY

Should any provision of these Terms be found unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted.

The invalid or unenforceable portion will be treated as removed without affecting the validity of the remaining provisions.

SECTION 18 – TERMINATION

These Terms remain effective until terminated by either you or us.

You may stop being bound by these Terms by ceasing to use the website, subject to any obligations arising from orders already placed.

We may suspend or terminate your access where we reasonably believe that you have breached these Terms, engaged in fraudulent activity or misused our services.

Any rights, obligations and liabilities arising before termination will continue to apply after termination where appropriate.

SECTION 19 – ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, Return and Exchange Policy and any other policies displayed on the website, constitute the agreement between you and Wjoud regarding your use of the website and services.

They replace previous communications or agreements relating to the same subject matter, except where otherwise agreed in writing.

Our failure to enforce any provision will not constitute a waiver of that provision or any other right.

SECTION 20 – GOVERNING LAW

These Terms and any separate agreement through which we provide products or services will be governed by the applicable laws of the United Arab Emirates.

Any dispute will be subject to the jurisdiction of the competent courts of the United Arab Emirates, unless applicable consumer law provides otherwise.

SECTION 21 – CHANGES TO THESE TERMS

The current version of these Terms will always be available on this page.

We may revise these Terms to reflect changes to our business, services, website or legal obligations. Any revised Terms will become effective once published, unless a different effective date is stated.

Your continued use of the website after revised Terms are published constitutes acceptance of those changes.
